Liability Waiver and Release(Required)

Please carefully read this Acknowledgement and Assumption of Risk, Waiver and Release from Liability and Indemnification Agreement (the “Release”) before signing. This Release is a contract. Its effect is to waive any claims you might have resulting from your participation in the activities (collectively, the “Event”) described below, namely the Anacortes Walk Fest. This document affects your legal rights and will bar your right to sue. Each participant in the Event must sign, or consent to, this Release. By participating in the Event, you further assent to the terms of this Release.

1. Acknowledgment of Risks:

I acknowledge that participation in the Event involves inherent risks, including but not limited to physical exertion, injury, fatigue, uneven terrain, sun exposure and hot weather conditions, inclement weather, rain, wildlife, water hazards or drowning, and other unforeseen hazards that may cause injury, illness, property damage, or death. Engaging in the Event activities may result in sprains, fractures, sun exposure, dislocations, concussions, cuts or abrasions, or other injury or illness. I understand that the above list is not complete and that other unknown or unanticipated risks, hazards and dangers may result in unforeseen injury or loss.

2. Assumption of Risk:

I assume and accept full responsibility for the risks identified above and for those risks not identified, in connection with my participation in the Event. I assume responsibility for my physical fitness and my capability to perform any activity in which I elect to participate. I further acknowledge that my participation in the Event is at my sole discretion. I understand and acknowledge that the Anacortes Chamber of Commerce and the organizers of the Event do not provide medical, disability, personal, or any other type of insurance for participants in the Event.

I acknowledge that I am ultimately responsible for my own safety during participation in the Event and I voluntarily assume all such risks. Further, I assume responsibility for any medical care that I seek or require.

3. Health and Fitness:

I certify I am physically fit to participate and have no medical condition that would prevent safe participation. I will notify organizers of any health concerns I experience during the Event. I will also immediately contact emergency medical response providers if I need urgent medical attention. I understand that no medical personnel will be on-site during the Event.”

4. Waiver and Release of Liability:

I hereby state that I wish to participate in the Event and Event-related activities. In consideration for doing so, I release and waive all claims against Anacortes Walk Fest, the Anacortes Chamber of Commerce, and the organizers and walk leaders of the Event, their officers, directors, employees, volunteers, agents, sponsors, property owners and affiliates (the “Released Parties”) for any injury, loss, damage, or death arising from my participation, whether caused by negligence or otherwise, to the fullest extent permitted by law. By participating in the Event, I further assent to the terms of this Release.

5. Indemnification:

I agree to save and hold harmless the Anacortes Chamber of Commerce and the organizers of the Event from any claim by me, or my family, estate, heirs or assigns caused by or arising out of my participation in the Event or Event-related activity, to the maximum extent permitted by law. I agree to defend, indemnify and hold the Released Parties harmless from any and all claims, costs, and expenses (including reasonable attorneys’ fees) arising from my participation or conduct.

6. Rules and Conduct:

I will follow all Event rules and instructions. Failure to comply may result in removal without recourse. I will act respectfully and exercise reasonable care.

7. Use of images and likenesses:

I grant and convey to the Event and its organizers all right, title, and interest in all photographic images, video, or other recordings and statements (“Materials”) taken of me during my participation in the Event, including but not limited to royalties, proceeds, or other benefits derived from the Materials. I grant to the Event and its organizers the unrestricted right and permission to use the Materials for any lawful purpose. I waive any right of publicity with respect to these Materials.

8. Governing Law / Severability:

If any provision of this form is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Release shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles. Any dispute arising from this Release shall be adjudicated in a federal or state court of proper jurisdiction in Skagit County, Washington.

Acknowledgment of Understanding:

I HEREBY CERTIFY THAT I AM OVER 18 YEARS OF AGE. I HAVE CAREFULLY READ THE FOREGOING AND ACKNOWLEDGE THAT I UNDERSTAND AND AGREE TO BE BOUND BY ALL OF THE ABOVE TERMS. I AM AWARE THAT BY SIGNING THIS AGREEMENT AND/OR PARTICIPATING IN THE EVENT, I ASSUME ALL RISKS AND WAIVE AND RELEASE CERTAIN SUBSTANTIAL RIGHTS THAT I MAY HAVE OR POSSESS. I HAVE HAD SUFFICIENT OPPORTUNITY TO REVIEW THIS ENTIRE DOCUMENT AND I AGREE TO BE BOUND BY ITS TERMS.

In consideration for the minor child being permitted to participate in the Event, I as parent/responsible adult guardian agree to all the Release’s terms and release, hold harmless, and indemnify all Released Parties from any and all claims and liabilities that may arise from the minor’s participation in the Event. I agree to be fully responsible for any medical expenses incurred by the minor child as a result of the child’s participation in the activity.
